Even i have the same situation, i got my AP approved and mailed, but my wife's still pending, even my recieved date was 13th june.

My friends received Green cards in 2007. They live abroad, but make regular trips tho the Us to visit family and maintain their GC.
Unfortunaltely, they recently misplaced their green cards. They are planning a trip to the US this month, for which they have received travel letters from the US Embassy abroad.
Would anyone know what the process is afterwords? We know they have to file I-90s to replace their lost GC. Does this have to be done at the port of entry? Or is it done at a local office on reaching their final US destination?
Also, will they be called for a biometric appointment locally or can that be done at a Port of Entry. Can the biometric be done at a location abroad?
If anyone has any info on this, it'd be truly appreciated.

I applied for my concurrent filing during the July 07 fiasco. My I-140 is still pending approval. I am hoping that it gets approved within the next month or so...my question is ...when can I switch companies for a same/similar job if I wanted to? Since my I 485 has been pending for over 180 days do I need to wait for my I-140 approval? if I do have to wait, can I switch as soon as I get my 140 approval?

So we refiled a new I-140 again PP, and referenced the labor certificate in the old case that we appealed.
They looked at the new case, and put in a request to get the original labor cert from the old case, which took about two months.
I received approval yesterday.

Hello everyone ! 13 years ago i was charge with Lanercy-theft wich it was a 2nd deg misdemeanor and possesion of cannabis under 20 grams 1st deg misdemeanor i plead guilty and served 3 days in county jail (Florida) , now i'm 32 married to an American citizen and getting ready to adjust my status , i just want to know how hard it"s going to be this whole process , i dont want to be dinied or deported , thanks for any answers.

My I-140 (National waiver approved, no labor required, self-petition) is approved, both me and my wife are working on EAD. Have valid AP till Oct 2009. 485s filed July 2007.
Today, on 10th, my wife (dependent 485) got hard LUD, "request for evidence notice sent" is the update.

The RFE is for absence of child's name (my wife) on the birth certificate. They wanted another birth certificate, hospital document or religious record or civil authority record that shows her name and both the parents names. They gave us 90 days time.

Here is my situation. greatly aprecite if you could give some suggestions.
I am presently on Non-cap H1b(which is not counted under cap). I am planning to file for H1b thru an employer in april under MS quota with a start date of octber 2008.
My concerns are...
1. How should the new employer file H1b so that I can join at my wish after oct 2008...??
2. My present H1b is valid untill 2010. SHould I be in US while filing and untill my new H1b is approved..??? I ahve plans of visisitng india in March/aprial. So wondering If i need to visit and be back before april or is it ok to travel while my new H1b is filed using the presnet i-94..?? that is trvelling sometime In april/May..???

However, my current lawyer emailed me this morning saying that you can transfer your PD, but not in the same category (EB2). In other words, to keep my PD, I will have to apply through EB1 or EB3 with my new employer. I had not heard of this before and was wondering if this is a true statement. Has anyone successfully transfered their PD within the same category? Thanks.

I am currently working on H1B1 � and my visa is valid till May 2009. The visa on passport (from last employer) is valid till March 2008. We applied for green card through my spouse�s company � our I485 has been applied (His H1B1 is valid till Mar 2008). We both got our Advance Paroles, and he got his EAD � about 5 weeks ago. Though my EAD was also requested at the same time, I have not received mine as yet.
Due to my husband�s job we are moving to another city in November. I plan to resign from my job at the end of November, and go for 6 week vacation to India. I plan to look for a new job (hopefully on with my EAD) when I get back in January 2008. I have following questions:
1. Now when I resign & my H1B1 gets cancelled, what would be my status in USA.
2. Do I need to get back to H4 status to come back to US (or just AP would be enough for POE)
3. Do I need to get back to H4 status to stay in US

My Original PERM labor certificate was lost in mail so we filed my I-140 without the PERM LC and asked USCIS to obtain the certificate from DoL. USCIS got the labour certificate from DoL and sent the original LC to us as an RFE to get my employer's and my signature on the perm certificate. My employer by mistake signed the labor certificate where I was supposed to sign :(. We have now covered his sign with white paint and I would be signing at correct place and sending back to USCIS. Do you think any white ink or over writing on original PERM certificate would matter in adjudication of my 140?
