    I can't see any good reason why they would do that unless they have a system to allocate the applications to adjudicating staff by State or by Region. Do the Chinese cite any reasons why they feel that way?

    HI,

    I have an H1b approval notice but as it clear the duration of the visa validity starts in October, today being 27 june and three months away from start of visa duration can i travel to India next month ( july) and be back in August as i am still on OPT and working full time in America now. I have got an oppointment with a consulate in India. Once i have got a stamp on my passport will i be permitted to enter back immediately or only in october, i need to make decision to travel now or later as if i am allowed back immediately it will affect my work.

    Agree with the cropping suggestion and also suggest you bring the highlights down some to bring out the detail in the barn roof and level out the barn. Just did a quick-and-dirty adjustment. You'll get better results from the original.

    My future employer "A" has filed an appeal I290B for denied I140 ("Inability to pay") which is pending at USCIS, however now my current employer "B" wants to file I140 for me. Both of this are on different labor approvals and different job descriptions. Can my current employer "B" file I140 without my future employer "A" withdrawing the I290B appeal? Will filing of I140 by my current employer "B" affect the denial of any of these applications?

    Is it possible to obtain a Greencard from L1B status? If yes, how long does this process typically take? My understanding is it is possible and definitely easier/shorter than being on H1?

    I see the following address in the I-485 form. But it is a PO Box address.

    P O Box 87485
    Lincoln NE 68501-7485

    I think Fedex will not accept PO Box address. Is it true ? So, what is the correct address for sending I-485 and I-765 using Fedex Overnight ?

    Please help me.

    For what it's worth, I was a Nikon pro card carrier back in the '70's. It was a FABULOUS service. I was allowed to borrow expensive gear for free that I would never have used otherwise (e.g. radio-remote release, medical telephoto with built-in ring flash, nikonos)

    And the "go the head of the line" repair service saved me more than once. While I was vacationing in California I needed some urgent repairs and was told by the local main Nikon repair shop that their backlog even for "urgent" repairs was 3 months. I flashed my pro card and it was in the repair shop by 10:00 and out by noon!

    Online status says my applications were recd on Oct 2/ 2007.

    My reciept notices show the right date in August.

    Is there any need to worry or notify any one about this?

    Thanks. But I heard if they find something critically wrong on 485 form, they may reject it and return it in as long as 3 month! Why can't they just make sure the forms are OK and then start the name check?

    Hi

    I am currently working on H1B visa. I also had an EAD which expired 2 months back & I applied for renewal of the EAD last month. I am at the risk of being laid off by my current employer & they will withdraw my H1B if that happens. Here are my queries-

    (1) If I lose my H1 status & my EAD approval is still pending, what do I need to do? If I am unable to find a new H1B sponsor, will I have to leave US immediately?

    (2) Will my H1 cancellation have any effect on my EAD & AP renewal petition?

    (3) Can I return to US & work after my AP & EAD are approved?

    (4) If my EAD approval happens before my H1B visa is revoked, can I legally stay & work in US on the basis of ONLY the EAD?

    Folks,

    I was on L1B and H1B for about 2.5 years around 2000-2003. I am now on TN for past 3-4 years and my current employer is going to chagne it to H1B.

    The company HR and I are under the impression that this would require a new H1B application (by April 2nd to qualify for the upcoming year 2008 H1B quota). However, the company attorney told us that since I was on H1B in the past, so we don't need to file for a new H1B petition against the 2008 quota...rather we can activate my old H1-B at any time and use the remaining time from the 6 year period.

    Does anyone know if there is any such provision to activate the old visa. I am under the impression that as I changed to TN status and no longer hold H1B, so it would require a new petition.

    Your opinion would be appreciated.

    Hello Everyone,

    Iam an H4 transferred to H1B. I am on H1B since one year. My pay is less than the one mentioned in LCA, but more than the prevailing wages. My job profile also includes some part of salary as comission, which I would get at the end of the year. This is apart from the salary Iam receiving right now (greater than the prevailing wage and less than LCA). Do I face any problem if I happen to go for H1B visa stamp. Could you also suggest me how to defend myself if I am asked the difference in the salary by visa officer. Thanking you all in advance.

    Very little chance of this causing a problem in getting H1 VISA Stamping.
