Hi All,
I am trying to change my wife from H1B to H4. There is this question in I539 for which I am not sure how to reply,
If you answered "Yes" to Question 3g in Part 4 on Page 3 of this form, fully describe the employment. Include the name of theperson employed, name and address of the employer, weekly income and whether the employment was specifically authorized byUSCIS.
would something of this sort be enough
I, xyz am working as a Systems Analyst with abc Inc. My job responsibilities include blah blah.
abc Inc is located at blah.
I am drawing a monthly salary of $xxx. A weekly income based on monthly salary would be $xxx

Regarding coming back on F1 after being on H4... You should really consider talking to an attorney. With F1 visa you need to prove that you would come back to India at the time of stamping, but with your spouse being on H1 and in states.. how do you thing you can prove that you will come back to India when your spouse is in the states..

bigboy007: As long as you have filled the form given by ASC officer and she has endorsed your FP notice, You are fine. ASC officer was right, single finger print will cover both of your applications. Just relax, I see no issues.

Hello,
Please report your employer to DOL for discriminatory pay practice, if you think the pay difference is solely 'cause of your immigration status.
And yes, you can change your job when you want through AC 21.. please browse the forum for AC21 process...good luck!

Friends, Please let me know your input-
Here is my backgound -
1.Current status working on H1B 8th year extension for company A
2.Labor and I-140 is approved � EB3 PD 04/2006 - Company A
3.485 pending applied in August 2007 (> 180 days) - Company A
4.EAD & AP approved - Company A
5.Wife on H4 Status not filed for her 485 as she was not here.
I want do H1b transfer & work for another company B -(Job code & job duties are little different)
I don't want to use AC21 - just continue with Company B on H1 B transfer.
I am doing H1b transfer nothing else once dates are current will add my wife.
Am I doing something wrong or screwing up my GC process?
Please advise

I have applied for family based GC above 21 yrs old on December 2006 and also currently holding h1 valid from October 2008. I also have my opt till May. Now since my employer was not able to find me a project he wants me to chg my status. I do not know what to do and how to chg my visa as, if I go on student visa I need to show financial documents and since I have not made any money how is it possible . If you can also suggest some schools who will not charge much or some courses which are not very expensive and time consuming and also where I can get work authorization as I will find jobs which are not technical and in line with my educational and work qualification . I have a deadline this evening as my employer just called me and told me this

Okay anyways, here is my entry. I drew this from a picture that was taken of me (left obviously) and my cousin in Disney World last June.
I'll scan it once I get my printer/scanner/cappuccino-maker all set up (just moved into a new place). I'll also scan the original photo so you can compare.
Anyways, I thought it turned out well, although I kind of look like a zombie and all my fingers look sort of broken. :lol:

My wife has H1 visa approved under Consular Processing from Company A, so she is still under H4. She got another offer from Company B so we applied for another H1B before H1B quota expired. It is under process.
1 ) we applied for COS from H4 to H1 By Company A by premium processing.
2 ) Company B H1B from H4 is also under process.
Does the order of outcome from either petetions affect another petetion. For example if companie A petetion is approved and then afterwards company B petetion is rejected. will she be in H1 status.

I am in L2 visa right now and I have an EAD to work. I got a job that I need to start on oct 01.
My spouse status will change from L1 to H1B from oct 01, as his employer filled for H1B.
Our L1 & L2 are valid until Aug 2011.
I don't have H4 yet.
What are the various options available for me to work?
1. Can I use my EAD to work which is valid until aug 2011?
2. Can I apply for H1B for me? If yes when I can start working with my H1B.

I am currently working on H1B visa. I also had an EAD which expired 2 months back & I applied for renewal of the EAD last month. I am at the risk of being laid off by my current employer & they will withdraw my H1B if that happens. Here are my queries-
(1) If I lose my H1 status & my EAD approval is still pending, what do I need to do? If I am unable to find a new H1B sponsor, will I have to leave US immediately?
(2) Will my H1 cancellation have any effect on my EAD & AP renewal petition?
(3) Can I return to US & work after my AP & EAD are approved?
(4) If my EAD approval happens before my H1B visa is revoked, can I legally stay & work in US on the basis of ONLY the EAD?

With the new EB2 how much time does it take for Labor to get certified..I am applying in texas region in guess. I am from louisiana -mississippi area. Anyone there from this area ?.
