Processing of 140 applications in NSC now takes 9 to 12 months . The movement of dates only will make things worse for processing of all the applications.
Hope it does not take more than a year for AP and EAD ...

Hi,
I just filed I-485 for myself and my wife. She is currently on OPT and has an approved EAD (F-1).
I can't seems to get a definite answer on how the filing will affect her status. Here's what I know so far, pls correct me if I am wrong:
1) F-1 is non-immigrant intent. Hence, when the I-485 is submitted she is no longer on F-1 but "AOS pending" status.
2) She "can" continue to work using the EAD. I said "can" because technically she is not supposed to but this is a grey area.
3) The PROBLEM is when she decides to travel. There is high risk that the immigration officer will see that she has filed I-485 and hence her F-1/OPT is no longer valid.
4) The PROBLEM in (3) can be circummvent if she uses AP from the I-485 application.
Am I missing anything? Thanks.

You can only change the name on the visa by applying for a new visa. Since that is probably impractical and too much trouble, I recommend keeping the visa as is until you need a new one. If the name on your other documents is your married name, you can carry a copy of your marriage cert. to show the reason for the difference.

In both cases dependent children were approved first, then primary applicant
(in one case in a 6 month after his dependent)

I have my I140 approved and I received my 3 yrs extension.
Question is can i shift jobs now? What are my options?
Once I move to the new job and file for GC, can I claim the old PD date ?

Apparently there are people who file for I-485 and I140 without labor approval.
I don't know how many people did this, but I heard there are cases of this kind.
What is the validity of this information? If it is valid, what are the risks?
The person who informed me went further explaining the procedure. He said that one needs to just file and wait for further documentation request from CIS. Upon labor approval complete documentation is presented to CIS.
Experienced souls, please advise.

Hi,
I applied for EAD renewal at NSC on 07/03/08 and today 08/06/2008, the status shows card production ordered. I applied for my wife along with me and her status shows still received.
Does the dependent (spouse) EAD in general get approved a few days after the primary applicants EAD is approved? I am not really using the EAD, its my wife who is using it, and thats the concern.

Here is a scenario:
Previous I 140 (EB2 PD Sept 2005) approved and is now current
Current I 485 filed based on another I 140 with PD in Dec 2006.
Can port over to the previous I 140 and can make I 485 current. The issue here is still unmarried so would like to hold on for few months to port over the PD.
Do you see an issue if porting is not done from EB2 Dec 2006 to the PD in EB2 Sept 2005?
How does it work if married after 3-6months and then want to port the PD for the spouse as well? Does Previous I 140 PD current still hold good?
If retrogression occurs once again do u still need to wait to port and get Green Card
