My H1 is expiring Jan'2011 with company A and company A has not filed my labor yet due to economic slow down.
As an employee of A, I have been working hard about 10-12 hrs day for last 3 years, and now they are saying they cannot file my labor.
Since, I'm not sure, if they will file my labor, I applied for h1 transfer in aug 2008 to company B but have not started working to company B.
I'm still working for company A, now that company B is willing to file my labor & 140 asap.
Now, If I move to company B and start working, what would be the chances of getting my labor approved through company B, I have been working here in US for last 5 years with great job history and tax history.

My i140 was approved 2 months back and now i got a Full time position in another company.
So my question is, after moving to new company if the dates are made current can i still file for i485 with my old employer if he agrees for it?

Hi,
My wife has a stamped H4 visa & I-94 both are valid through Oct 16th 2008. We have applied H1B for her which got approved somewhere in May 2007.
The Approved H1B documents along with new I-94 is with her employer.
We have some issues with the employer so we are not sure that we can get the H1B & I-94 documents from her employer.
As we also applied for EAD,In the mean time if we receive her EAD card and Travel Document for my wife.
Do we still need her H1B and new I-94 documents from her employer for any reason?
Any advise is well appreciated.

This is my situation:
I am in my 8th year of H1B extension (2 one year extensions after 6 years)
I had my LC I140 approved, but due to retrogression I cannot continue with the adjustment of status.
This is my question:
If I move to a new position that would require me to file new LC (PERM), am I still subjected to the 365 days rule?
I am confused because my employer filed the LC 365 days prior to my H1B expire on the 6th year in order to get the extension. Now, since I can only have one year extension and I have less than 1 year left on my H1B visa, can the new LC still be filed? Will this jeopardize future H1B extension?
Am I missing something here? Is there another strategy?

The category (EB2/EB3) doesn't get transferred. Only the PD can be transferred. So, you will get the old PD for EB3.

I would like to have a list of documents/forms needed to file for derivative I-485 for spouse.
I did come across a few lists on the web, some overlap and some don't, but they do not necessarily address the full list of documents needed when Primary's I-485 is already pending and spouse is filing separately at a later time.
The derivative beneficiary is already in US on a dependent Visa, looking to do AOS instead of CP.
I would appreciate if anyone can provide a list and it'll be great if any members in a similar situation have done it themselves.

House Democratic leaders are drafting a resolution designed to inoculate freshman lawmakers on the issue of immigration, despite concerns from within their own Caucus about reopening debate over the contentious topic.
According to several freshman Democratic lawmakers in attendance at a weekly breakfast meeting with Speaker Nancy Pelosi (D-Calif.) and Caucus Chairman Rahm Emanuel (D-Ill.), Members were told to prepare statements on the resolution, which will endorse laws already on the books that prevent illegal immigrants from participating in taxpayer-funded programs, such as Social Security or food stamps.
In a draft of the resolution obtained by Roll Call, the measure expresses the sense of the House "with respect to the importance of upholding federal immigration laws and ensuring the integrity and security of the borders of the United States."
In addition to the language on public benefits, the draft resolution also contains provisions calling on the executive branch to enforce laws on voter fraud and border security.
But one House lawmaker, who asked not to be identified, said some senior Members have objected to the proposal over concerns that it will be difficult, if not impossible, to limit the scope of the debate. The House largely abandoned plans to pursue a comprehensive immigration reform bill earlier this year after the Senate failed to cut off debate on its own version of the legislation, effectively killing the bill.
Majority Whip James Clyburn (S.C.) and Majority Leader Steny Hoyer (Md.) began work on the resolution earlier this month in response to repeated Republican efforts to force votes on immigration on the House floor through the use of procedural amendments.
"We're trying to figure out a way we can do this and maintain party unity on the motions ... without making it a crisis," said one Democratic lawmaker, who is a member of the Whip operation.
Although one Democratic lawmaker, who asked not to be identified since plans have not been finalized, said the measure could move to the floor as early as next week, a House leadership aide said it is unlikely to be that soon.
To date, Democratic leaders have not demanded that Members vote against all motions to recommit - a procedural tool that can be used by the minority party immediately before a vote on final passage of a bill - unless the amendment contains language that would shelve the legislation.
"I've resisted motions to recommit unless they're substantive and then I'll vote for them," explained Rep. Tim Walz (D-Minn.), a freshman lawmaker who has faced attacks from the National Republican Congressional Committee for votes against some GOP-authored amendments on immigration.
"It's frustrating to me," Walz added, criticizing the amendments as political footballs. "I'm appreciative that our leadership lets us vote accordingly."
But that policy led to some confusion on the House floor in early August during a vote on a GOP-authored amendment to the Agriculture spending bill to prohibit illegal immigrants from accessing certain federally funded programs, with nearly 20 Democrats initially voting in favor of the proposal.
Republicans allege that the Democratic majority mishandled that vote, resulting in the defeat of the measure. GOP leaders assert that a tied 214-214 vote - rending a defeat - announced by the Speaker Pro Tem was inaccurate and that the motion had in fact passed 215-213 as Republicans changed their votes.
But Democrats dispute that version of events, noting that their own Members were changing votes on the House floor, resulting in the final tally of 212-216.
The dispute prompted the establishment of a select committee to investigate the vote, which is scheduled to hold its first meeting this morning, and produce an interim report Sept. 30.
Republican Rep. Tom Price (Ga.), who has sponsored similar amendments addressing the use of federal funds to assist illegal immigrants, including a measure that failed Tuesday night on a federal housing bill, expressed interest in the Democratic proposal.
"I'd love to be able to talk with them about it and work on it," Price said. He could not say whether such a measure would deter him from offering such amendments in the future without seeing the details of the bill.
"When I talk to folks at home they want to know why we're not including this language on every single piece of legislation," he added.

I-140 processing date isn't country specific, but make sure check the date for the center you have applied to - the date varies by center

I filed my I-485 in Aug�2007 and my I-140 is approved in EB2. My daughter was on dependent H-4 and her I-485 also was filed in Aug�07 as dependent on my GC. She completed 21 year in June�2008.
My question is if we receive our GC in current year, she will get GC as she already crossed 21 years? Appreciate your answer and thank you in advance.

Hello All,
I had attended H1 interview in last week of Nov 2007. I had got 221g BLUE form to submit additional documents from Petitioner.
I submitted all documents through VFS drop box in last week of Jan 2008. Does anyone has any idea within how many weeks time we will get some response from Chennai consulate?
I was not asked to submit passport and hence I havent submitted passport.
I appreciate any inputs from any one.

I joined company ABC on H1B in 2005.
In Nov 2006 company XYZ filed my GC.
H1B got transferred to a couple of companies because I changed jobs while GC was being processed in parallel without being affected by my job changes because it was filed by another company.
In Oct 2007 got my EAD for a period of 1 year. Kept working on H1B only though.
EAD expired in Oct 2008. Applied for a new card but never received it. Did not apply for one after that.
In Nov 2009, I quit my job and moved back to home country giving up my H1B while still not affecting my GC because company XYZ agreed to keep it under process.
So at this time, I have no H1B and no EAD card. My priority date is however going to be current soon.
Now...
1) Do I have to be in the country before my dates get current or can I do that later?
2) On what status do I enter?
3) Can I delay the process somehow without affecting my GC?
