Does it mean the eligibility criteria/job requirement for EB2 is changed from 5 to 10 years?
I don't know but I'm scared now....My attorney is filing 140 this week and I was planning on premium processing.
Is this memo in effect already or what? Can someone throw more light on this?

If you need solutions to your problems, you need to act professionallly as all other IV members do. Please stop throwing tantrums and also mind your P's and Q's when you utter expletives against USCIS. Will you be brave enough (if not foolhardy enough) to reproduce whatever you said here in a letter and send it out to the USCIS? Trust me, you'll not since you'd act politely and professionally to make out your case. We expect you to act with decorum when you discuss pertinent issues in IV forum.

Of course the vote had to fail. Senate is Dem controlled and they are anti-legal presently. But the fact that it got voted down by a few votes should give us some optimism.

We are one of those unluckiest ones; I changed my company 2 months before July fiasco and (EB2 PD Aug 23, '06) and never got a chance again to file I-485.
It is very frustrating (to say the least) to wait and it seems it may take another ~2 years to file I-485. It is hard on my wife in particular as she completed her masters in 2008 and narrowly lost jobs offers because companies do not wanted to H1b transfer these days.
I do not see any hope of this agony end anytime soon :(

a) The obvious, in April spill over happens. India Jumped from U to 1dec 03 in April08
b) in 2008 April India Eb2 tied with China Eb2 as India Eb2 was unavailable in March 2008
given the regulation of giving spillover by earliest date India Eb2 held China Eb2 at the 1Dec03 date for the month of April 2008
c) This year has not needed any pd backward movement for India. This is unlike 2008 where it went to Jan02 and Jan00 to U. This means India Quota itself is still being used and yet we are at 15 Feb 04.
Please let me know if you see any more interesting things in this.

hey,
It seems like you are inspiring lot of peoples to upgrade to EB2 which is good. Actually saying this and really doing a successful upgrade takes time and depends on lot of things like economic situation.
After my Eb3 I-140 finally got Approved in Jan 2009 , I started searching for employers who would do the Eb3 to Eb2 upgrade .. But there was no job , not even contracts - so who will file a EB2 PERM labor for you in that situation ? Plus if someone files a EB2 Labor just like that - they could be audited. The Job needs to be EB2 level and you need to have Eb2 qualifications which lot of Eb3 has - But both conditions has to meet for a "successful upgrade".
What do you say ? Do you know any other shortcut than what i mentioned - then please enlighten us :)

gimmeliberty, srinivas_o, x1050us, PKV4voice thank you so much. I was out for about a couple of hours and when I came back I saw all these contributions lined up. I cannot express the feeling I got. I was totally overwhelmed. After yesterday’s round, which took about 24 hours to close (estimation, I didn’t check), I was worried if we will be able to finish this round. But I am certain now that we will finish this round successfully. Of course, we will, if we have motivated people like you.
