    I got my labor approved only on May 26 ,2006. My Pd was March 12,2002 EB3 Va.

    I've already entered details into http://www.trackins.com

    Here is a little good news for most....
    I had estimated that I would get my approval around beginning Sept, but I got it about 6 weeks earlier. I had been tracking estimating etc., also I had asked a paralegal about whether her customers were being processed in order or if people were disappearing into black holes (as a few appear to a trackins.com). None of her customers were in black holes.

    Currently it does appear that Nov and Dec 2002 are being processed at Philly BEC, and in general it does seem to be advancing in date order, with a few approvals now being a few months behind (oldest approval recieved in Dec 2006 was Aug 2002) so the spread was Aug 2002 to Dec 2002 being processed in June 2006. This is based on info at trackins.com and my paralegal's customers.

    Also from trackins.com it appears that most 45 day letters have been issued.
    They made a public commitment (and in court) to have data entry done by end of June 2006 (i.e. next week). So anyone who has not received a 45 day letter by the end of July should be banging on their door. They appear to be close to all data entry done, so that estimate looks to have been credible. Thus their estimate of all applications processed for Sept 2007 gains some credibility.

    Also I based my estimate of when I'd get my LC partly on their estimates of when they'd finish LC processing.

    Please leave a comment on this thread, after you have mailed the letter & Form. It will motivate others to do the same. If you really want some justice, stand up and get counted by participating in this campaign. Else, Julu-Aug 07 filers, will keep waiting and will have to go through frustrating and agonizing wait for an uncertain period.

    Dear Friends!

    (By mistake I posted this in another thread. I think this is the right one)

    Good Morning and Happy New Year! Wish you all success, good health, peace of mind and great prosperity!!!

    Though I visit the forum quite often, I do not particiapte in a big way. I just read to understand the view points of others. After a lot of hesitation I took time to draft this note!

    I am not sure how far my views would find acceptance, but I would like to share some of my thoughts!

    1. Although I would sincerely like to give credit to the IV forum for all what they have done (and doing), I personally feel that that the days of prayer and petition are gone!

    2. To achieve something concrete and tangible, atleast a minimum of 100,000 (Desis + Chinese / Filippinos if possible) should rally in Washington DC to press our case.
    This alone will generate enough publicity. We can show our strength and if there is a consensus, opt for a hunger strike.History has always shown that "direct action" alone has yielded results.

    3. Unlike European countries where the laws of immigration and naturalization are simple, here it is very convoluted and confusing. All laws in the USA ONLY favour the employers and the law firms. Due to this, several of us have been harassed by our employers.


    4. Instead of harping on the existing archiac and immigrant unfriendly rules, we could propose something like this:

    a. Provide Green Cards for all legal immigrants who have completed 8 years of continuous stay, as on say, June 1, 2010. Continuity would mean not leaving the USA for a period of 90 days at a stretch. (I have completed more than 9 years personally, but I am suggesting a time line of 8 years because H1 is valid for 6 years and L1 is for 7 years. It will certianly not acceptable for the US Government to provide GC to every H1 / L1 holder. Any period below 8 years may meet with very stiff opposition)

    b. The legal immigrants with 8 + years should have a criminal free record (barring minor traffic offenses) and should have filed their tax returns

    c. Citizenship status should be provided to all legal immigrants with 10+ years

    Note 1 : Rules in the UK/ Europe are :

    Permanent residency after 5 years of legal stay
    Citizenship after 10 years of legal stay or 15 yearls of illegal stay

    5.We are always getting drawn into the trap and quagmire of the existing regulations and the INS / US goverment / Law firms / Employers are enjoying the fun

    Note 2: I have stated everything based on my stay in different countries and keeping in mind the interests of the immigrant community very sincerely. It is upto IV to publish this or discard this. I will also NOT respond to any comments / cristicisms. I am just requesting the readers to kindly intrsopect!

    To be honest it seems that all of the points you made here are by taking yourself into consideration.

    Most of the people here know about immigration policies in Europe, but here the system is altogether different. Isn't it? It will require herculean effort to turn around the whole system. And by the way the current system is not too bad, its just that USCIS sucks big time.

    In months of June, Jul and Aug , many EADs & APs are up for renewal due to July07 fiasco. So by moving dates forward, USCIS can cash in lot of reveue as it has to issue only 1 yr EAD in that case. If the dates are not current, they will have to issue 2 yr EAD and although they dont mean to approve many cases, I tend to think they will keep moving dates forward.

    Hey,
    Looks like my employer will fill up the 7001 form but how about the main letter. Does that needs to be signed and addressed by employer as well ?

    Because the Link for 7001 doesn't talk about sending a separate cover letter.

    Your employer does not need to sign the letter. You can sign the letter. On section 12 of the form 7001 mention " please see the attached letter" and then include the letter to be mailed to Ombudsman's office.

    These are all good thoughts but what u are suggesting takes some time.
    The issue has two legs:
    Leg 1: Process fix
    Leg 2: Increasing number of greencards

    What I am talking about is leg 1 and what you are talking about is for leg 2
    and both are required.

    Sanjeev - I personally feel there is no easy solution for this. Our efforts must be well organized and there has to be geniune effort. A lot of people who post here are all frustrated and angered and they channelize their anger and frustration through these forums whereas instead if it is channelized in a positive way - our campaigns will be more effective and we can reach our goals.

    I don't know if anyone of you has ever gotten on a rush hour train in mumbai. But before leaving for the US, a wise man told me that going to the US is like getting on a train in Mumbai, it's a struggle to get in. You'll have to push, shove, maybe stand on the footboard for a while. But once you get in, hold on tight until you get to your station. That's the philosophy I apply to all of this green card mess. I will hold on tight until my station comes.

    My personal opinion is that the US is really not that unfair when it comes to immigrants. All the complaining that we do about unfairness, we do because we hold the US to American standards. We expect justice, effeciency, fairness that is expected of the US of A. We would not even have a chance to complain in most other countries (such as the middle-east, asia and to some extent Europe), because we would quite simply agree that we are always foreigners in those lands, no matter how long we live there, and that our rights as foreigners are limited.

    Despite not having a GC, I have never felt like a foreigner here (I grew up in a bunch of countries, so I think I have a a few points of reference). I don't think having a GC will change anything. I can buy property and invest, work as I like, drive a car, speak my mind, pretty much do anything an american can.

    We all seem to think GC is a magic bullet that solves all our problems. But in my observation, I have seen people languish in middling careers even after getting a GC, and I have seen people shoot up in their careers, or start successful businesses on H1B. GC might make things easier, but it certainly will not ensure success.

    All of us are intelligent, enterprising risk-takers. I say risk-takers because setting up life in a new country is always fraught with risk. And we have taken that path. So we must accept all the ups and downs that come with it.

    So my friends, if you're on the train, hang tight till your station comes. If you're planning to jump off mid station make sure you jump off in the direction of the train. :)

    I finally got the Loan Approved !

    The underwriters was OK with my H1B + I-140 Approval + I-485 Reciept.

    Thank you all for the tips and leads.

    After a long 60 day wait, I m finally getting the house on Monday. :)

    Congratulations!

    I never had a problem with my immigration status in regards to getting a home loan. In fact, I got approval from 3 banks and I chose the one with lowest interest.

    That is not true. Receipt Date is when the service center physically receives the package. They date stamp it and then use it to enter that RD when they generate the Notice on the ND.

    What you see on the status page for sure reflects the ND and NOT the RD. So you can pretty much ignore what the status page says and rely on what your physical notice says (it states the actual RD when they physically received the package!)

    Hope this is a clear explanation.

    RECIPT DATE is the date when they input your info in the system. Before inputting in the system they check I140,medicals,etc. Notice date has no bearing. If your packet looks fine you get your receipt number and then you will be able to view the status on uscis.gov. The status will be something like "On july 9th 2007 we received your applivction ..............etc"

    I am confused and think about this daily. I am here in US for the past 8+ years and I am 33 now. All my friends who have stayed back in India are in very good managerial position and earning well. Money is not the issue now, but the career.

    I thought about going back to India and when I started the job search, I ended up seeing myself aged out. Being stuck with my GC, I am now continuing as a Sr Software er for the past 8 years. I did not move up an inch all these years and I did not think it is going to affect my career till now. Now if I look back, I sometime think that I have made wrong choices unknowingly.

    In India:

    1. I am not fit for Sr Software Er position as guys from college with 2+ years of experience fills that position.
    2. I dont want tech lead / team lead as I hear from my friends there it is going back 5years for me for my age.
    3. I am not getting project manager position as I do not have any managerial experience.

    If I get a good position in India, I am ready to go back. At the same time, I have two kids who are born here in US and I own a house (technically I am proud owner of mortgage debt not house) here in US. I have to close all my debts before I decide to go back.

    I AM NOT IN CLEAR STATE OF MIND. MAY BE GETTING GC WILL HELP ME OUT.

    Exactly same thoughts cross my mind too. I am planning to finish my Masters, on a part-time basis, after which I have to decide my direction for good. I don't have any kids so that is not a factor to hold me back to this country. But I face my biggest discouragement about returning to my home country, when I think of a typical workplace atmosphere there. If you are working for one of the software firms delivering services to international clients, you might end up as someone who simply follows the orders from overseas clients - working 14-15 hours at least 6 days a week. Add to that the living conditions, feudal bureacracy and you have conjured up a recipe for formidable hardship and frustration. On the other hand, US has a growing economy and newer opportunities come here first. Also I have quite a few friends here who have got theirs GCs and are doing good. So, that serves as a sort of inspiration for me.
    So, overall, I am also confused. My wife is my driving force, positive about making it big here- business or corporate world and my only hope. But she has been put up at home, now for more than 4 years; pretty hard to imagine especially with MPhil and an MS from US universities.

    USCIS can process recaptured numbers. If 200k numbers are in one year USCIS will plan for 200k numbers in that year.In 2000 they processed more applications after a immigration reform. One way of preventing wastage is plan to process all the applications in 11 months. If any unused numbers can be processed in that one month.

    I would like to have whatever you are smoking when you type these things. Seriously man...give us a break, will ya? Is there a point system by which people get GCs if they play the devil's advocate? I would like to sign up for that.

    The Ombudsman's report clearly stated how USCIS wasted all these visa #s due to their ineffieciency, very well knowing that these #s cannot be re-used the following year. Why don't you send your below mentioned valuable advice to USCIS and see if you can make them do the right thing instead of "educating" us("One way of preventing wastage is plan to process all the applications in 11 months")

    The important thing is, not all BEC cases are alive today. Most people moved on to PERM. On the flip side, some newbies took advantage of substituted Labor, but I am guessing the count is not very high.

    So if we have 150K BEC + 144K PERM, then in reality, the total 485 primary applicants will be < (150K + 144K).

    More like 200K, I would think. Including spouses and foreign born kids, the number would be 400K (as not all primaries are married).

    Add some more applicants from eb1, etc., who do not require Labors and the number should not exceed half a million in total including dependants. But again, we are speculating. In reality, the total may be less than half a million or more.

    Assuming DOS and USCIS are efficient and use up all 140K visas each year, all of us should have GCs in < 4 years. The per country quota may cause some trouble, which may require adjusting the timeframe a little bit, but not much.

    good point which has been overlooked.

    thus one can say lack of social security numbers for spouse and kids of a high skilled immigrant waiting for gc causes sevaral administrative and taxation issues.

    Please also note:
    Gor GC waiters, the child tax credit will not be available for kids under age 1.
    In Oct 2004, my kid was 6 months when she landed in US.
    When she was 9 months in Jan 2005, I tried to include her in my tax returns but IRS said I can not include her until she becomes one year old.
    This year 2006, I could include her after getting her an ITIN.
    In short, child taxation issue is there only for one year at the maximum.

    I called each one of them! And explained to let us file 485 immeditely after 140 approval! And talked about putting us in front of line before undocumented workers!
