i've been in the US on a f-1 visa since 2006. i am getting my masters at the moment. i am planning on getting married to my girlfriend who is a US citizen. i have been with her for the past 2 years and am dearly in love with her. we plan on getting married and i was wondering if i get married to her, can i apply for a green card right away or do i have to wait for a while before i can apply for a green card. she is also a student getting her bachelors.
my second question is that if i can apply for a green card then could i take a semester off and return to studying next semester or would that be a problem since i am on an F-1 visa.
i would appreciate it if i could get an answer soon so that i could take the semester off.

I am kind of worried as it has been more than 2 weeks and I have not yet recieved my EAD while my spouse's came within 3 days.
I was wondering if someone got his/her card even after 2 weeks as generally it take 5-10 days. Any advice would be highly appreciated.

My huband is working in H1B in USA? In most of the job boards they ask this question:
Are you legally authorized to work in the country in which you are applying?
what should i specify yes or no? Can somebody explain? Please it is urgent?

Hi,
I received an RFE for proof of maintaining legal US residence in the form of I-797 forms of H1b extension or EADs etc. What was surprising is that we had not filed a medical exam with the original 485 application as we couldnt get an appointment in time before the retrogression and thus have been waiting for an RFE for the same. Yet they have not asked for it.
Can we (in addition to providing the required docs for the RFE), send the medical exam sealed envelope (obtained later but within the past year) even though it wasnt requested yet? The USCIS provided envelope is of course too small to put everything into but we plan to attach it to the couriered docs. Does this sound reasonable?

When I entered USA on L2 dependent spouse visa,my passport was expiring on 15 Sept 2008 and hence my I-94 got departure date as 15 sept 2008. After that i applied for an L2-EAD with the old passport and I-94 (both having expiry date as 15-sept-08)and hence i got the L2-EAD which also expires on 14-sept 2008.
Now I have renwed my passport which is valid upto 2018 and want my EAD to be renewed.
Can someone tell me L2 EAD expiry date depends on I-94 records or does it depend on my spouses L1 or on my new passport expiry date...or may be out of all these which ever expires first....??

I filed my I-485 and I-140 together in July 2007 using substitute labor (priority date) in Eb3 category.
I have Master degree, so can I change my category from EB3 to EB2 and keep the same priority date?

my wife and i went to renew our DLs.
i am on EAD and my wife is on AOS(pending 485) and we both have AP valid till feb 2010.
i got a temporary DL and will get 1 year DL in the mail.
my wife got temp DL but will get DL till feb 2010 only (expiration of AP-I94). they wanted to see I-140 or I-130 alongwith I-485.
i emailed flhsmv.gov and they also say that now you must show 140 and dependent names in 485 application which most of us dont have.

I resigned my job last year on Dec 15th 2006 by giving my employer a 2 weeks notice (dec 29th was supposed to be the last working day). A week later, i informed my employer that i won't be leaving them at which time, he suggested that i continue working as normal and that he would take care of un-doing the paper work. They had sent out a letter to INS to revoke my 797 even before my last working day with them. The HR contact has failed to follow-up and inform the INS of this development and am told last week that i have been out of status for 10 days now (March 10 was the day INS revoked my H1b). The company has accepted responsibility for this mess and are filing an accelerated H1b (premium) application this week. I had continued employment this whole time and never had any break in my payments. Are there any chances the INS won't put be back on H1 status with my company ?.
