    I got laid off from Company A in Jan.2009 but I filed transfer for my H1-B to Company B based on receipt notice which I have for Company A. but Just now I came to know from USCIS that Transfer which I filed for Company A in Oct.2008 has RFE and Company A denied to answer RFE cos I am no longer their employee.

    Question:

    1. Can I get a receipt notice for Company B ?
    2. Is there really an Issue for my Transfer to company B due to RFE in previous filing?

    Appreciate your responses.-Thank you

    Hi

    I filed my 485 on June 4th 2007 with NSC. It was transferred to TSC and received my Receipt notice. Now I am going to file my AP.

    My question is where should I file my AP?. Do I need to file with NSC or TSC?.

    Please someone respond.

    Hello,

    I have this situation and need some advice or if anyone can share their experiences.

    H1b extension was denied with reason of "Employer-employee relationship". RFE was responded to (with requested pay stubs and W-2) and was still denied. Now, attorney from company is filing for MTR. How long does MTR processing take as the case was already existing? Does that matter or it doesn't? How long did it take to get a decision from CIS?

    Is it possible to file MTR from company A (employer) and to file a new petition from company B (middle vendor who has direct contract with client)? Can the MTR be withdrawn in favor of a new petition?

    Did anyone go for MTR and how many days did it take to get the decision?

    If we could add some good things for legal immigrants (EB), and the bill gets passed in senate... what are the chances of getting it passed in house and reaching president's table. The reason for this concern is that same thing happened in Dec 05, when at the last moment all immigration stuff was reformed from budget recon. bill. I am sure IV must be thinking about this as well and would like to get IV team's views on this. Also wanted to thank IV team for taking so many efforts.

    For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications.     My I-485 application was filed under EB3 category when I was working for my previous employer (PD - October 2006). I changed my job in August 2008, but never sent any documentation for AC21. I now have close to 8 years of experience and also a masters degree (MBA) from a reputed univeristy here in the US.

    Now that EB2 dates are so close to October 2006, is there anyway I can port my application from EB3 to EB2? I can initiate this discussion with my current employer and may be able to convince them to help me. But I want to know exactly what needs to be done.

    Thanks a lot in advance for your assistance in this matter!

    I gave first FP on 9/28 and lat month I took info pass and the officer raised a SR for non delivery of cards to which I got a reply that my card might have lost in mail. I called USCIS who mentioned that my card was never created and now it will be created. Now my online status changes mentioning that I have been sent FP notice again. I called uscis again and mentioned that I already gave biometrics

    The officer said it was erroneous so ignore the FP notice and he will be requesting CPO for me. I even called FBI FP line today to confirm that my first FP was fine and they said it was fine and uploaded

    What a chaos? We were so close, turned out to be mirage. When do you expect your GC? My PD is Feb 2006. I do not expect anything positive in 3 years. I doubt anything changed in our career in 2 years. Where do we stand?

    Frankly speaking, I always thought that this is going to harm the people with older priority dates but I never vented out. It turned out to be true. They chose almost randomly among the ones who filed during that time and quite many with old priority dates were left out. I think had that fiasco not been there and had priority dates moved slowly, the things would have been more streamlined.

    On March 19, 2010, the USCIS announced revised filing instructions and addresses for applicants filing an I-131, the Application for Travel Document.

    Beginning March 19, 2010 applicants will have to file their applications at the USCIS Vermont Service Center or at one of the USCIS Lockbox facilities.

    If you file the I-131 at the wrong location, the USCIS Service Centers will forward it to the USCIS Lockbox facilities for 30 days, until Monday, April 19, 2010. After April 19, 2010, incorrectly filed applications will be returned to the applicant, with a note to send the application to the correct location.

    My I 485 receipt does not have a priority date. Is it common to have an I 485 without a priority date.
